This is the terms of use for templates purchased/downloaded from this site, modifications also fall under these terms of use as well.1. Important Information
You should carefully read the following terms and conditions. Your purchase or use of the products implies that you have read and accepted these terms.
2. License
Our website grants you a nonexclusive limited license to use the web templates and other products sold through our web site by independent content providers (the "products") in accordance with these Terms and Conditions (the "license") issued by Biron Inc.
a) Limited Usage Granted
You may only use each individual template on a single domain name. You have to purchase the same template once more in order to
make another project with the same design.
b) Modifications
You are authorized to make any necessary modification(s) to this product to fit your purpose.
c) Unauthorized Use
You may not place any of our products, modified or unmodified, on a diskette, CD, website or any other medium and offer them
for redistribution or resale of any kind.
1) Selling of Your Website
If you sell your website you must first remove the template unless you are selling the domain name with the site. Please contact us
if you do sell your site so we can update our records.
d) License Transfer
You may not sub-license, assign, or transfer this license to anyone else without prior written consent from Biron Inc.
e) Template Access
If you require a new copy of the template, you can send an email with your paypal email address and domain name to recieve
the copy via email.
f) Ownership
You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of
Biron Inc and the original creators of the templates.
g) Refusal of Service
We reserve the right to refuse, cancel, or suspend service at our sole discretion.
h) Copyright Credits
With each template is included a "Layout By Biron Inc" image in the footer. This image can be replaced by text if necessary.
1) Free Templates
You are NOT allowed to remove the credit for free templates. You may send a payment of $5 via paypal to webmaster@arcadecreate.com to
gain permission to remove the credit if you wish.
2) Purchased Templates
You ARE allowed to remove the credit for purchased templates.
3. Liability Disclaimer
THESE PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED. BIRON INC SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, BUSINESS, INTERRUPTION OR THE LIKE), ARISING OUT OF THE USE OR INABILITY TO USE THE WEB PRODUCT OR THIS EULA BASED ON ANY THEORY OF LIABILITY INCLUDING BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF BIRON INC OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
